Terms and ConditionsAUCTIONEER2GO AUCTION TERMS AND CONDITIONSBy using our services, it is assumed that you have read the terms and conditions provided here, and are expected to abide by them. These terms and conditions apply to all Auctioneer2Go auctions. Additional specific auctions may have additional terms and conditions that will listed on the site for that specific auction. As a Bidder and/or Buyer, you agree to the following terms and conditions and the terms and conditions of the specific auction. 1. Buyer's Fees: Buyer shall pay to Auctioneer2Go a buyer's premium of 10% of the successful bid amount. All Buyers must pay the buyer's premium. If an item is subject to sales tax, Auctioneer2Go shall collect sales tax at the time of payment. Tax shall be calculated based on the successful bid price plus the buyer's premium. 2. Auction Close: Time and date is indicated the auction sale you are watching. Items with a bid in the last 1 minute will be extended for an additional 3 minutes. This will repeat as long as there is a bid within the last 1 minute. 3. Auctioneer2Go's Role in Auction: Auctioneer2Go is acting as agent of the seller in an online auction and is not responsible for acts of omissions or representation of the seller or any of the seller's principals, officers, directors, employees or other agents. 4. Removal of Items/Shipping: Removal of items from the auction site or warehouse is the sole responsibility of the Buyer. All items must be removed from the auction site by the date and time specified on the auction website. If Buyer is not able to personally remove items, Buyer can arrange shipping with Auctioneer2Go. At Buyer's request, Auctioneer2Go will ship items to Buyer via FEDEX or a similar carrier. If Buyer requests that Auctioneer2Go ship smaller items under 150 pounds not needing a pallet, Buyer shall pay to Auctioneer2Go, along with the purchase price, buyer's premium and sales tax if applicable, the shipping carrier's specified shipping rates. On total purchases weighing 150 pounds to 1,000 pounds (or items needing a pallet), there is a $25 palletizing fee per pallet. If your total purchases weigh over 1,000 pounds, please call to arrange the shipment. 5. Contract and Payment:. Any bid that you make becomes a binding offer to buy the item for the bid amount, buyer's premium, sales tax, and any other applicable fees or charges. A legally binding contract between a bidder, on the one hand, and Auctioneer2Go and seller, on the other hand, is formed when a bidder makes the highest bid and the online auction is closed. All sales are final; a bidder may not cancel a bid after the auction closes. When the auction closes, the highest bidder (referred to herein as "Buyer") shall pay for the item purchased by the date and time identified for removal on the specific auction site. If Auctioneer2Go determines that the highest bid was not a bona fide bid, the item will not automatically go to the second highest bidder. If Buyer does not pay for and remove an item within the applicable removal period, Auctioneer2Go may resell the item without notice. If an item is resold for an amount less than the original, highest successful bid, Buyer is obligated to pay the difference. If full payment is not made by the end of the applicable removal period, Buyer's bidding privileges as to any other Auctioneer2Go auctions may be suspended. Buyer's bidding privileges might not be reinstated until Auctioneer2Go's invoice has been paid in full, regardless of whether an item has been resold. Bidders must be 18 years old The seller has the right to remove assets from the auction either before or after bidding has been completed. In the event of a removal after bidding has been completed, the purchaser's sole remedy shall be the refund of any purchase price actually paid. Auctioneer2Go will announce any additions to or deletions from the catalog on the day of the auction. Auctioneer2Go and the seller assume no responsibility for, and make no representations or warranties concerning, descriptions of assets contained in marketing materials for the auction. It is the bidders' obligation to verify such descriptions prior to the auction. Neither Auctioneer2Go.com nor seller shall be liable for any damages of any type or nature (whether in contract, tort or otherwise) sustained or claimed by any bidder or any other person or entity in connection with the auction. Without limiting the foregoing, in no event shall Auctioneer2Go.com liability to any bidder for any act or omission occurring in connection with the auction exceed the amount that such bidder has actually paid to Auctioneer2Go.com as a deposit or as payment for a purchased item. Title to items passes to Buyer when full payment for all items has been received and all items have been removed from Auctioneer2Go's warehouse or other removal location. Upon removal of an item from Auctioneer2Go's warehouse or other removal location by Buyer or Buyer's agent, or by Auctioneer2Go at Buyer's direction, risk of loss shall pass to Buyer. It is the seller's responsibility to provide Auctioneer2Go the title and all applicable forms for their items. 6. Warranties and Condition of Items: Bidders are responsible for inspecting all items before the end of the auction. There will be inspection days specified for all auctions. All items are sold AS IS, WHERE IS, and WITH ALL FAULTS. There are no express or implied warranties. Descriptions, pictures, or anything else is for the bidder's convenience and identification purposes only. BUYER WAIVES ANY AND ALL CLAIMS AGAINST AUCTIONEER2GO AND SELLER BASED ON THE CONDITION OR VALUE OF ITEMS. 7. Indemnification: Buyer indemnifies and holds harmless Auctioneer2Go, its directors, officers, employees and agents against any damage or loss which Buyer, Auctioneer2Go or third-parties may suffer or incur with respect to loss, damage or injury arising from the removal of an item. 8. Arbitration and Court of Law: All disputes relating to an Auctioneer2Go online auction and the terms and conditions herein shall be governed by and interpreted in accordance with the laws of the State of Minnesota. All claims relating to an Auctioneer2Go online auction and the terms and conditions herein shall be brought in "District Court in Stearns County, Minnesota," and bidders hereby consent to the jurisdiction of said Court. ***Reserve Items within Auctions*** Auctioneer2go is making the effort to CORRECT something, that some Other Online Auction Sites have been suspected of: THAT BEING the activity of "suspicious" Bids raising the bid price giving buyers the feeling that we are being ripped off by unscrupulous Auctioneers or Auction houses. Here is our way of attempting to bring Honesty to the forefront of the Online Auction World. We hope that others will follow our lead and STOP any shenanigans. IF you are a "Consignee" with A2G and have asked us to list an item. (Let's use a Car as an example) AND the Kelly Blue Book on that car (or known and excepted value of most untitled merchandise) is, let's say $10,000.00. We do NOT expect you to list with us, WITHOUT a RESERVE PRICE, where You may take a severe beating on the money you receive, just so we can receive our commissions. (THIS IS WHERE THE DISHONESTY SEEMS TO BE TEMPTING SOME FOLKS IN THE CASES WE HAVE BEEN TOLD OF) OR you get your cousin or someone else to "jack the bid" up and complain about having to pay the "buyers premium" to buy back your own car OR worse yet "the Auction House" condones such "bid jacking". (and quite frankly IF you are a "Bid Jacker" you deserve to be Jailed for Stealing, let alone paying a few bucks your discrepancy) IF you are a "Bidder" on this Car, by rights you would like nothing better than to drive away with a $10,000.00 vehicle for 20 bucks, because of some unexplainable freak of computerized nature, where no one else was interested in bidding. AND there was no RESERVE.(BUT let's be realistic) IF you are a serious bidder and it is a Car you would like to own AND the Reserve Price Listed with us is $6,500.00 (Remember only we and the Consignee, know this reserve price) and lets say you came across this perfect vehicle, on the first day of the auction, and placed the opening bid of $20.00. Let's say that your FIRST Maximum Bid is placed at $6,000.00 (This being a Maximum Bid that you will gladly raise to $7,100.00 if needed, later in the auction) On the last day of the auction the Bids reach $6,000.00 and You raise your Maximum bid to your limit of $7,100.00, to be sure to safeguard your status as lead bidder. (Remember the $6,500.00 reserve is NOT MET YET) and You are the High Bidder BUT because no one ever put in the $6,100.00 to $6,500.00 bids. 1). You never had the opportunity to own the car of your dreams for $6,600.00 .. 2). The Consignee never had the opportunity to sell the vehicle. 3). A2G never got to collect any commissions, and my children didn't get to go to college. THEREFORE.. IF you are a Consignee with A2G and "Selling" items on A2G AND have proven to us that the Reserve Price that you are asking (for any item) is realistic.(generally meaning from 40% to 70% of the accepted value) We Will Allow You to Bid Your Own Item UP TO the Reserve Price. BUT NO FURTHER. IF You are listing Items Without a Reserve YOU SHALL NOT bid on your own items PERIOD. ANYONE caught bidding beyond these terms or conspiring with another bidder to do so, OR using the services of this Site for ANY FORM of ill gotten gain, WILL be banned from this site and or prosecuted to the full extent of the law..(Be aware that, we are smarter than we look, and behind the scenes we have ways of tracking suspicious activity) OUR PHISOPHY IS THAT: 1). BOTH Sellers and Bidders are Important Customers of Ours 2). Trustworthy Sellers are needed 3). Being Trusted by Bidders IS A MUST We will rid ourselves of bad customers Quickly, in the attempt, that Honest Folks may live in Harmony. CU@A2G
